That answer depends on where in the country you are employed.<\/em>&nbsp;<\/p>\n\n\n\n<p>Thinking about leaving your job? You are not the only one. Recent studies show that many people have either left their jobs or <a href=\"https:\/\/www.bnnbloomberg.ca\/more-canadians-planning-to-leave-their-jobs-in-the-next-12-months-statscan-1.1816789\" target=\"_blank\" rel=\"noreferrer noopener\">are actively considering it<\/a>. Dubbed \u201c<a href=\"\/blog\/en\/the-great-resignation-and-the-life-lesson-for-employers\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Great Resignation<\/a>\u201d in HR circles, there are numerous <a href=\"\/blog\/en\/why-people-quit-their-jobs-during-the-pandemic\/\" target=\"_blank\" rel=\"noreferrer noopener\">reasons<\/a> and <a href=\"\/blog\/en\/7-signs-its-time-to-quit-your-job\/\" target=\"_blank\" rel=\"noreferrer noopener\">causes<\/a> which can lead people to seek out new employment opportunities. These can include serious reasons such as <a href=\"\/blog\/en\/remote-work-burnout-is-on-the-rise\/\" target=\"_blank\" rel=\"noreferrer noopener\">employee burnout<\/a> and not having <a href=\"\/blog\/en\/8-employee-expectations-in-2022\/\" target=\"_blank\" rel=\"noreferrer noopener\">their needs<\/a> meant by management. There is a formal process to resign your employment. These include writing <a href=\"\/blog\/en\/how-to-write-a-professional-letter-of-resignation\/\" target=\"_blank\" rel=\"noreferrer noopener\">an official letter of resignation<\/a>, free of <a href=\"\/blog\/en\/7-common-mistakes-when-writing-your-letter-of-resignation\/\" target=\"_blank\" rel=\"noreferrer noopener\">common resignation letter mistakes<\/a>, and informing management that you will be leaving. This is called giving your notice. It is standard practice to provide employees with two weeks&rsquo; notice when leaving your job. But is this an actual legal requirement or is it simply a professional courtesy?&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-do-you-have-to-give-two-weeks-notice-when-leaving-your-job\"><strong>Do You Have To Give Two Weeks\u2019 Notice When Leaving Your Job?<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Contrary to popular belief, there is <strong>no universal legal requirement<\/strong> to give two weeks\u2019 notice when resigning from your job in Canada. The answer is a bit complicated because some provinces and territories in Canada do have provincial laws requiring employees to provide specific periods of notice when resigning from their job. In provinces where there is no specific requirement, there is still a legal requirement and precedent to provide \u201creasonable notice\u201d when leaving your job.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What Is \u201cReasonable Notice\u201d When Leaving Your Job?<\/strong>&nbsp;<\/h2>\n\n\n\n<p>What does and does not constitute \u201creasonable notice\u201d is a matter of precedent in both your jurisdiction, and can also depend on your job title, the nature of the role and the industry where you are employed.&nbsp;<\/p>\n\n\n\n<p>\u201cAn employee is obligated by law to give reasonable notice of termination to his or her employer, even absent a written contract of employment. If the resignation is voluntary, the notice to which the employer is entitled becomes a matter of law, not merely a matter of conscience or responsibility on the part of the employee. The main purpose of the notice of resignation is to allow the employer a reasonable time to find a replacement.\u201d &#8211; Justice Sandra Chapnik, <em>Sure-Grip Fasteners Ltd. v. Allgrade Bolt &amp; Chain Inc., [1993] 45 C.C.E.L. 276 (Ont. Gen. Div.)<\/em> at pages 281-282&nbsp;<\/p>\n\n\n\n<p>In <a href=\"\/blog\/en\/how-to-get-a-job-in-toronto\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ontario<\/a>, for example, there have <a href=\"https:\/\/www.wrongfuldismissal.ca\/two-weeks-notice-in-ontario\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">been instances<\/a> of employers taking employees to court for failing to give reasonable notice even when they informed their employers two or more weeks beforehand. This is due to the specialized nature of their job role, which the employer must be able to demonstrate made it difficult to find an adequate replacement. Fortunately for workers, these cases are not widespread because the legal onus remains on the employers to prove that the alleged lack of notice caused demonstrable financial harm to the company.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What About Employment Contracts?<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Many employment contracts include a requirement for two weeks\u2019 notice when leaving a job. Failing to provide two weeks\u2019 notice in this case would be a violation of the employment contract and open the departing employee up to additional penalties and possible legal ramifications should the employer choose to pursue it. It is also possible for employers and employees to discuss the situation together, and mutually agree to waive this section of the employment contract and make it official through a <a href=\"https:\/\/www.hellobonsai.com\/a\/online-contract-maker\">contract maker<\/a>.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Should You Give Two Weeks\u2019 Notice?<\/strong>&nbsp;<\/h2>\n\n\n\n<p>While not a legal requirement in every part of Canada, providing two weeks\u2019 notice \u2013 or at least some period of notice \u2013 when leaving a job could prevent some headaches for everyone involved. Employers have time to <a href=\"\/blog\/en\/hiring-talent-from-anywhere-in-the-world-5-tips-to-get-started\/\" target=\"_blank\" rel=\"noreferrer noopener\">find a new hire<\/a> or <a href=\"\/blog\/en\/7-recruitment-metrics-to-help-you-create-a-better-hiring-process\/\" target=\"_blank\" rel=\"noreferrer noopener\">start the process<\/a>, and employees fulfill their contracts and positively contribute to their professional reputation.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Do You Have Two Give Two Weeks\u2019 Notice?: What Each Province Requires<\/strong>&nbsp;<\/h2>\n\n\n\n<p><strong>British Columbia<\/strong>: <a href=\"https:\/\/www2.gov.bc.ca\/gov\/content\/employment-business\/employment-standards-advice\/employment-standards\/termination\/quit-fired\" target=\"_blank\" rel=\"noreferrer noopener\">No<\/a>. There is no legal requirement of two weeks&rsquo; notice when resigning from a job in British Columbia.&nbsp;<\/p>\n\n\n\n<p><strong>Alberta<\/strong>: Yes, there are legal requirements for giving notice when leaving your job in <a href=\"https:\/\/www.alberta.ca\/termination-pay.aspx#jumplinks-1\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Alberta<\/a>.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Fewer than 90 days: no notice required&nbsp;<\/li>\n\n\n\n<li>Over 90&nbsp;days, but under 2&nbsp;years: 1 weeks\u2019 notice&nbsp;<\/li>\n\n\n\n<li>2 or more years: 2 weeks\u2019 notice&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><strong>Saskatchewan<\/strong>: Yes. Employees who have been working for <a href=\"https:\/\/www.saskatchewan.ca\/business\/employment-standards\/layoffs-and-termination\/individual-layoff-or-termination#:~:text=Minimum%20Notice%20Employees%20Must%20Provide,employee%20is%20ending%20their%20employment.\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">over 13 weeks<\/a> must give their employers two weeks\u2019 notice when leaving their job.&nbsp;<\/p>\n\n\n\n<p><strong>Manitoba<\/strong>: Yes, Manitoba has legal requirements <a href=\"https:\/\/www.gov.mb.ca\/labour\/standards\/doc,terminate-employment-after-apr-30-07,factsheet.html#q40\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">specifying the period of notice<\/a> when leaving your job.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Fewer than 30 days: no notice required&nbsp;<\/li>\n\n\n\n<li>Over 30&nbsp;days, but under 1&nbsp;year: 1 weeks\u2019 notice&nbsp;<\/li>\n\n\n\n<li>1 or more years: 2 weeks\u2019 notice&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><strong>Ontario: <\/strong>No. The only time an employee is <a href=\"https:\/\/www.ontario.ca\/document\/your-guide-employment-standards-act-0\/termination-employment\" target=\"_blank\" rel=\"noreferrer noopener\">required to provide<\/a> a specific period of notice to their employers is when the employee has already received a notice of termination as part of a mass layoff.
